How we work with you, and how we handle your information when you use FlourishKay Travel & Tour for visa assistance, study abroad support, holidays or flight booking.

This page is a general template written for a visa, study abroad and travel agency operating between Glasgow, United Kingdom and Lagos, Nigeria. It is provided for convenience and is not legal advice. Before publishing it, have it reviewed by a solicitor familiar with UK GDPR, the Nigeria Data Protection Act, and consumer/travel regulation in both jurisdictions, and update the placeholder details (registered company name and number, registered address, and any package-travel or ATOL-style licensing that applies to your specific services).

Terms & Conditions

1. Who we are

"FlourishKay Travel & Tour," "we," "us" or "our" refers to FlourishKay Travel & Tour, operating from offices in Glasgow, United Kingdom and Lagos, Nigeria. "You" or "client" refers to anyone who enquires about, books, or uses any of our services, including on behalf of a spouse, child, or other dependent.

By instructing us to act on your behalf — whether by submitting a form on this site, replying to an advisor, or paying a deposit — you accept these Terms & Conditions and the Privacy Policy below.

2. Our services

We provide the following services, either directly or by coordinating third-party providers on your behalf:

  • Visa and immigration application support (documentation review, form completion, interview preparation, and submission guidance) for the United Kingdom, Canada, the United States, the Schengen area, Australia, the UAE, Ireland, Germany, Malta, Turkey, the Maldives and South Africa
  • Study abroad guidance, including university and course shortlisting, admission processing, statement of purpose review, blocked-account (Sperrkonto) setup assistance for Germany, and pre-departure briefing
  • Holiday and leisure travel packages, including flights, accommodation and transfers
  • Domestic and international flight booking
  • Business and delegation travel coordination
  • Paid travel consultations

We act as an intermediary and advisor. Final decisions on visas, admissions, and entry are made by the relevant embassy, consulate, immigration authority, or educational institution, none of which we control.

3. Bookings, quotes & payment

Quotes for visa assistance, study abroad support, or travel packages are valid for the period stated in your quote, or for 14 days if no period is stated, and may change if exchange rates, embassy fees, airline fares, or supplier prices change before you pay.

Where we offer instalment or flexible payment plans, the schedule agreed with your advisor forms part of your contract with us. Government, embassy, visa, examination and third-party supplier fees (airlines, hotels, universities) are separate from our service fee and are payable in addition to it unless we state otherwise in writing.

Work on your file — document review, form preparation, or submission — begins once we receive your service fee or the agreed deposit, whichever your advisor has specified.

4. Cancellations & refunds

If you cancel before we have submitted an application on your behalf or ticketed a booking, we will refund what you have paid us, less any work already completed and any non-refundable third-party costs already incurred (such as booked flights, hotel deposits, or paid embassy fees).

Once an application has been submitted to an embassy, consulate, or institution, or a flight or hotel booking has been ticketed or confirmed, our service fee is non-refundable, and any refund of the underlying booking or application fee is subject to the airline's, hotel's, or authority's own cancellation policy — not ours.

Refusal of a visa, admission, or entry by a third party does not, on its own, entitle you to a refund of our service fee, since that fee covers the work of preparing and submitting a complete, accurate file rather than guaranteeing a particular outcome.

5. Visa & immigration disclaimer

We prepare your file to the standard we believe gives it the best chance of success, based on the stated requirements of the destination country at the time of preparation. We do not work for, and cannot bind, any embassy, consulate, visa office, or immigration authority, and we cannot guarantee that any visa, permit, admission, or entry will be granted.

Immigration rules, processing times, and document requirements change, sometimes with little notice, and are set entirely by the receiving country. Where a decision depends on an interview, biometric appointment, or discretionary assessment by an official, the outcome is outside our control.

6. Your responsibilities

To act for you, we rely on you to:

  • Give us accurate, complete and truthful information and documents, and tell us promptly if anything changes
  • Meet document, payment, and appointment deadlines your advisor gives you
  • Attend biometric appointments, medical examinations, or interviews arranged in your name
  • Tell us about any previous visa refusals, immigration violations, or criminal record that may be relevant to your application

We are not responsible for delays, refusals, or additional costs that result from inaccurate information you provide, from documents you fail to supply on time, or from your failure to attend a scheduled appointment.

7. Liability

We will provide our services with reasonable skill and care. Except where caused by our negligence, we are not liable for losses arising from decisions made by embassies, consulates, immigration authorities, airlines, hotels, or educational institutions, or from circumstances outside our reasonable control (including strikes, extreme weather, or changes in law or policy).

Nothing in these Terms limits or excludes any liability that cannot lawfully be limited or excluded, including liability for death or personal injury caused by our negligence, or for fraud.

8. Complaints

If something has gone wrong, tell your advisor or email hello@flourishkaytravel.com with your name and file reference. We aim to acknowledge complaints within 3 business days and resolve them within 14, and will let you know if a complex case needs longer.

9. Governing law

Where you engage us from our United Kingdom office, these Terms are governed by the law of Scotland. Where you engage us from our Nigeria office, they are governed by the law of the Federal Republic of Nigeria. Either way, you may also have rights under the consumer protection law of the country you live in.

PART TWO

Privacy Policy

FlourishKay Travel & Tour is the data controller for the personal information described below. This policy explains what we collect, why, and the choices and rights you have over it.

10. Data we collect

Depending on which service you use, we may collect:

  • Identity & contact details — full name, date of birth, gender, nationality, phone number, email address, home address
  • Travel & immigration documents — passport details, photographs, visa history, biometric appointment confirmations, and (for study applications) academic transcripts, English test scores, and admission correspondence
  • Financial information — bank statements, sponsor letters, proof of funds or scholarship award, and payment details for our own fees (processed via our payment provider — we do not store full card numbers)
  • Enquiry & communication data — messages, form submissions, and call or WhatsApp records connected to your file
  • Technical data — pages visited on this website and how you found us, used to keep the site working and to understand which pages are useful

Where a form on this site opens your own email app rather than submitting directly to a server, the data you enter is sent from your device straight to us by email when you press send — we do not store it separately on this website.

11. How we use your data

  • To assess your visa, study, or travel options and prepare your application or booking
  • To communicate with you about your file, including reminders and follow-ups
  • To submit applications to embassies, consulates, universities, airlines, hotels, and other providers on your behalf, with your instruction
  • To take payment and keep the financial records we are legally required to keep
  • To meet our own legal, regulatory, and anti-fraud obligations
  • To improve our services and this website

We do not sell your personal data, and we do not use your immigration or financial documents for marketing.

12. Legal basis for processing

For clients in the United Kingdom or European Economic Area, we rely on: performance of a contract (preparing and submitting your application or booking), your consent (for optional marketing communications), our legitimate interests (running and improving our business, preventing fraud), and legal obligation (record-keeping, anti-money-laundering checks).

For clients in Nigeria, we process personal data on the equivalent bases recognised under the Nigeria Data Protection Act 2023, including your consent, contractual necessity, and compliance with a legal obligation.

13. Who we share your data with

We share the minimum information needed, with:

  • Embassies, consulates, and immigration or visa-processing authorities, to submit your application
  • Universities, colleges, and admissions bodies, for study applications
  • Airlines, hotels, insurers, and other travel suppliers, to make your bookings
  • Payment processors, to handle your payments securely
  • Regulators, auditors, or law enforcement, where we are legally required to

We do not share your data with third parties for their own independent marketing purposes.

14. International transfers

Because our work is international by nature, your data may be sent to countries outside the UK or Nigeria — for example, to the embassy or university of the country you are applying to. Where we transfer personal data out of the UK or EEA, we use appropriate safeguards such as standard contractual clauses, or rely on the transfer being necessary to perform your contract with us (for instance, submitting your own visa application to the country you asked us to apply to).

15. How long we keep your data

We keep client files for as long as needed to complete your service, respond to any follow-up queries, and meet our legal and financial record-keeping obligations — typically up to 6 years after your file closes, unless a longer period is required by law or a shorter period is agreed with you. Documents you ask us to delete sooner will be deleted unless we are required to retain them.

16. Your rights

Subject to applicable law, you can ask us to:

  • Give you a copy of the personal data we hold about you
  • Correct information that is inaccurate or incomplete
  • Delete your data, where we are not required to keep it
  • Restrict or object to certain processing
  • Provide your data in a portable format
  • Withdraw consent, where consent is the basis for processing (this does not affect anything already done based on consent given earlier)

To exercise any of these rights, email hello@flourishkaytravel.com. UK-based clients also have the right to complain to the Information Commissioner's Office (ico.org.uk); Nigeria-based clients have the right to complain to the Nigeria Data Protection Commission.

17. Cookies

This website uses only the essential technical storage needed for it to function, such as remembering that you have closed a pop-up. It does not use third-party advertising or tracking cookies. If that changes, this section will be updated and, where required, a cookie banner will be added.
